MDCLC's City Attorneys Luncheons offer
local government attorneys the opportunity
to discuss timely issues in the legal
community. Continuing Legal Education
(CLE) credits are often awarded for
those who attend. Held on a quarterly
basis, the MDCLC furthers its efforts
to foster professional discussion amongst
our local government attorneys.

"Who owns the privilege"
The
attorney client privilege is one of
the major cornerstones in the practice
of law. There is some debate but no
definitive law on the issue of when an
attorney is representing a municipal
client, whether the entire governing
body owns the attorney-client
privilege, such that it can be waived
by that body, or whether individual
members of the governing body can
claim the privilege, even if that
individual’s interests diverge from
that of the governing body. “Who has
the right to waive the
privilege?” This seminar will delve
into that issue and arguments on both
sides of the issue will be presented.
